    Dubby Energy Privacy Policy

    1) Introduction

    This Privacy Policy describes how www.dubby.gg

    (the “Site”) and Dubby, LLC (“Dubby,” “we,” “our,” or “us”) collect, use, share, and safeguard your personal information when you visit the Site, purchase our products, or interact with us by email, SMS, ads, or social media (collectively, the “Services”). Please read this policy in full before using the Site.

    We believe in clear, direct privacy practices. This policy explains:

    2) What We Collect

    A. Device & Usage Information (Collected Automatically)

    • Examples: IP address, cookie IDs, device IDs (e.g., IDFA/GAID where applicable), browser type, OS, time zone, pages viewed, referring/exit URLs, on-site actions, approximate location (city/state), and email engagement signals (opens/clicks).

    • Why: Operate and secure the Site, remember preferences, measure performance, diagnose errors, prevent fraud, and improve products and marketing.

    B. Order & Account Information (You Provide)

    We treat information as “Personal Information” when it identifies, relates to, describes, or can reasonably be associated with you.

     

    3) How We Use Personal Information

    We process Personal Information to:

    • Provide the Services: Process payments, fulfill and deliver orders, handle returns, send order confirmations/invoices.

    • Operate & Improve: Maintain and secure the Site, debug, personalize on-site experience, optimize navigation, and enhance our product lineup.

    • Communicate: Order updates, service notices, support responses, product news and offers (according to your preferences and applicable law).

    • Marketing & Ads: Measure and improve campaigns, retarget visitors, build lookalike audiences (where permitted), and prevent ad fraud.

    4) How We Share Personal Information

    We share Personal Information only as needed with:

      • Service Providers: These are vendors that process data solely on our behalf to provide services like website hosting, checkout, payment processing, order fulfillment, customer support, email/SMS communications, analytics, and advertising measurement. This includes platforms such as Shopify (storefront/checkout), Klaviyo (email), Attentive (SMS), and other logistics and anti-fraud providers.

      • Advertising/Analytics Partners: We use partners such as Meta, Google, TikTok, and Microsoft/Bing to measure campaign performance and, where permitted, deliver relevant ads. For California residents, we enable Meta’s Limited Data Use feature and configure these platforms to act as service providers when technically available, meaning they may not use your data for their own independent marketing.

      • Legal/Compliance: To comply with laws, subpoenas, or lawful requests, and to protect our rights, property, and safety.

      • Business Transfers: In a merger, acquisition, financing, or asset sale, data may transfer as part of the transaction.

    We do not sell Personal Information for money. Some state laws define “sale” or “sharing” to include certain advertising disclosures. See Section 12 (California Privacy Rights) for opt-out options.

    Service Providers & Processors
    We share personal information only with vendors and partners that process data on our behalf to operate our website, fulfill orders, send communications, provide analytics, and measure marketing performance. These partners (such as Shopify, Klaviyo, and Meta when Limited Data Use is enabled) are contractually or technologically restricted from using personal information for their own independent marketing purposes.

    We use:

    • Functional Cookies: Preferences, saved settings.

    By providing a mobile number and opting in on our Site (e.g., at checkout or via a form/keyword), you agree to receive recurring automated marketing texts (e.g., promos, cart reminders, notifications) from Dubby at the number provided. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply.

    • Sharing: Your phone number, name, and purchase info may be shared with our SMS provider (Klaviyo) solely to deliver and manage messages (and with carriers to complete delivery).
       Alternative opt-out requests (e.g., using other words) may not be recognized by the system—use the keywords above or email us.

    The website uses cookies to help keep track of items you put into your shopping cart including when you have abandoned your cart and this information is used to determine when to send cart reminder messages via SMS

    We will not share your opt-in to an SMS campaign with any third party for purposes unrelated to providing you with the services of that campaign. We may share your Personal Data, including your SMS opt-in or consent status, with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages.

    Note: Opt-outs are typically browser/device-specific. You may need to repeat them on each browser/device you use.

     

    8) Lawful Bases (EEA/UK Users)

    Where the GDPR/UK-GDPR applies, we rely on: consent, contract performance, legal obligation, legitimate interests (e.g., site security, fraud prevention, product improvement, advertising where balanced), and vital/public interests where applicable.

     

     

    9) Data Retention

    We keep Personal Information only as long as needed for the purposes described in this Policy (e.g., tax and accounting retention for orders), to resolve disputes, enforce agreements, and comply with law. When no longer needed, we will delete or de-identify it.

     

    10) Security

    11) International Transfers

    Our Services are operated in the United States. If you access from outside the U.S., your information will be transferred to and processed in the U.S., which may have different data-protection laws. Where required, we use appropriate safeguards (e.g., Standard Contractual Clauses and UK addendum) with our processors.

    California (CCPA/CPRA)

    If you are a California resident, you may have the right to:

    • Know/Access: The categories and specific pieces of Personal Information we collected, the sources, purposes, and categories of third parties we disclosed to (past 12 months).

    • Delete: Request deletion, subject to legal exceptions.

    • Correct: Fix inaccurate Personal Information we maintain.

    • Opt-Out of Sale/Sharing: Opt out of “selling” or “sharing” Personal Information for cross-context behavioral advertising (we do not sell for money; some ad disclosures may qualify as “sharing”).

    • Limit Sensitive PI Use/Disclosure: We do not use or disclose Sensitive Personal Information for purposes that require a “limit” request under CPRA.

    • Non-Discrimination: We won’t discriminate for exercising your rights.

    Opt-Out of Sale/Sharing: Use your platform/industry opt-outs (Section 7). Click the “Do Not Sell or Share My Personal Information” link in our footer or email us.

    We do not knowingly sell or share Personal Information of consumers under 18.

    13) Your Rights Under the GDPR (EEA)

    If you are in the EEA, Dubby is the data controller for your Personal Data processed under this Policy. You may have the right to:

    • Access your data and obtain a copy

    • Rectify inaccurate/incomplete data

    • Erase data (“be forgotten”) when we no longer need it

    • Restrict processing under certain conditions

    • Port data to another service (machine-readable format)

    • Object to processing based on legitimate interests (including direct marketing)

    • Withdraw Consent at any time (where processing is based on consent)

    14) Your Rights Under the UK GDPR

    If you are in the United Kingdom, your rights mirror the GDPR rights above. For international transfers, we use SCCs with the UK International Data Transfer Addendum where applicable. You can lodge complaints with the ICO (Information Commissioner’s Office).

     

    15) Automated Decision-Making

    We do not engage in fully automated decisions that produce legal or similarly significant effects about you. Our partners (e.g., payment/fraud tools) may run limited, time-bound automated checks (e.g., temporary IP/credit-card deny-lists) to prevent fraud; these do not have legal or similarly significant effects on you.

     

    16) Children’s Privacy

    Our Site and products are intended for adults 18+. We do not knowingly collect Personal Information from anyone under 18. If you believe a minor provided information to us, contact contact@dubby.gg and we will promptly delete it.

     

    17) Do Not Track

    There’s no industry standard for “Do Not Track” (DNT) signals. We do not currently respond to DNT.

     

    18) Changes to This Policy

    We may update this Policy to reflect changes in our practices, technology, or legal requirements. If we make material changes, we’ll post the updated Policy on this page with a new “Last Updated” date. Please review periodically.
